Recently it has been issued the Decision of Ministry of Manpower No. 104 of 2021 on Guidance on Implementation of Work Relation During Corona Virus Disease 2019 (Covid-19) Pandemic (“Guidance”). This Guidance regulates the technicality of work system adjustment to prevent and minimize the spread and reduce the risk of Covid-19 in the company or at work such as (i) The implementation of Work From Home (“WFH”) and Work From Office (“WFO”), (ii) Wage, and (iii) Work termination prevention measures.
In a brief, the implementation system for WFO under this Guidance can be done by (i) determining the percentage of the number of employee who do WFO, (ii) regulating the allocation of working days in 1 (one) month in rotation, and (iii) reducing working hours by making shift to the employee. While the implementation system for WFH is by requesting the employee to work from home in rotation. Further, the provision of wage under this Guidance regulates the arrangement of wage adjustments in relation to WFO or WFH based on a written agreement with the employee and reported it to the local Manpower Office. For the work termination prevention measures under the Guidance, it regulates the alternatives to avoid work termination during Covid-19 Pandemic.
